Any kind of physical contact in any kind of relationship is wrong of course, but in some instances it could be seen as a form of defense if the person was under the impression that they were about to be hurt. Indeed, there have been many cases where someone has actually killed another person while they were asleep to avoid further attacks. What the expert does is to show that the accused was put under so much emotional pressure that they snapped when the going got too tough for them.

These cases are becoming more and more common when a person who has been thoroughly brow beaten will suddenly feel that they have nothing else to lose. Often this comes in the middle of the night and this is how the prosecution says that the killing was tantamount to murder since it was premeditated. However, some psychologists believe that the individual can have a mental break when the perpetrator is asleep which means that they cannot be harmed in return.

Where children are concerned, mothers have an innate sense of right and wrong and will often put themselves in the firing line to stop them getting hurt. In many instances the court will listen sympathetically when the accused tells their story in which the details may be very gory indeed. But often what goes on behind closed doors is kept secret so that no one knows the extent of it. When the details are revealed of course we all feel something for the victim and will tend to vote for the accused.

Possibly the best thing that anyone can do, when they find themselves in these circumstances, is to tell all those close by what is going on and get it registered so that if anything should happen in future, there will be proof. This is not always possible, but if the victim could just let someone know then at least this will surely be noted somewhere.

Even men fall foul of women who slap and punch without a second thought and there are many who will just not fight back. Men often feel a little disenfranchised as having to admit that they are being knocked about but the court will not differentiate between either sex when this happens. Indeed, they will be more inclined to take the children away from her too should she show this kind of behavior in the home which will surely have some kind of effect on them in future times.
