Burglar Released Despite Californian Three Strike Rule.

September 1st, 2010

After being behind bars for thirteen years for attempted burglary a man has now been released despite Californian law stating that the three strike law decides whether or not a burglar is released. The burglar in question committed his ‘third strike,’ after attempting to enter a church kitchen.

A Los Angeles based superior court judge decided to reduce the sentence to just eight years, which the convicted burglar had already served. The original jail term handed down in 1997 was for twenty five years. Those watching the case have reported that when the decision was read out the convicted man began to cry with relief.

Amongst those who witnessed the case unfold was law student Reio Rogozen who admitted, ‘I thought I was going to cry, too.’ Many of those attending the court hearing felt certain that the conviction and sentence would remain unchanged.

When the decision was announced to the court convicted burglar Taylor thanked the court and his family and friends who stuck by him.

The conviction came about when Taylor was arrested way back in July 1997. He was caught attempting to break in to a church kitchen in Los Angeles. The defence he gave police was simply that he was hungry.

This conviction then resulted in him becoming guilty of so called ‘three strike’ burglary as he had two prior convictions for street robbery offences committed in the eighties. None of his offences were violent though, and nobody was harmed in any of them.

The appeal laid out for Taylor also compared him to a character in the novel Les Miserables. The court were reminded of the character Jean Valjean who was convicted and imprisoned for stealing bread.

The three strike rule is normal practice in Californian state law and therefore lots of people have found the result of this recent case fairly shocking. It is thought that it will now cause a surge of similar non- violent cases to be revaluated.

How To Choose A Minneapolis Criminal Lawyer

August 15th, 2010

Has a plus against the prosecuting panel. One of the best things a criminal lawyer can give his clients is a wider view of your case. It is because of this that he can scrutinize your case from all elaborate positions and create a calculated line of defense against all forms of offense from the prosecutor. Your defense holds a good advantage if, for instance, you chose a criminal defense lawyer who once served as a public prosecutor. As a consequence, your attorney can see your stand from the standpoint of the prosecuting lawyer and compose a formidable defense fashioned with the know-how and experience of both a defense and a prosecuting lawyer.

Has abundant years of experience in the domain of criminal defense. Medals and trophies may represent the lawyer, but the only thing that substantiates any lawyer’s assertions of expertise is the expanse of experience he has gained in the domain of criminal defense. At times, a lawyer may say he has been serving for decades in the legal world, but you have to know whether those years were spent precisely in the criminal defense area. A legal professional who has been five years in criminal defense is undeniably more advantageous than a lawyer who has been leaping from one area to another in the last 20 years.

Accepted by his peers. A good legal professional is someone who is bears a status of honesty and dependability among his fellow lawyers. Professionals in the legal world have established societies that go through self-regulation to certify the integrity of their line of work. At best, any person offering legal services should be a reputable associate of the American Bar Association and the State Bar Association. Your selected criminal defense representative should be recognized by the National Association of Criminal Defense Lawyers and the National College of DUI Defense no less, the two most reputable national organizations founded to sustain excellence in criminal defense.

Commits profession completely to criminal defense. Specialization on one area of expertise secures that a lawyer has used all his available reserves for his immense development in that one field. Scattering himself too thin across all areas of practice in the legal industry will not improve any lawyer, since most wisdom is obtained not in law school but out in the real world itself, where lawyers argue for authentic cases where real human beings are concerned and the effects of any success or guilty verdict in a case are real. Would you rather hire a lawyer who has jumped from real estate, to corporate, to family and divorce, to criminal defense or would you rather commend your future into the hands of a lawyer who has been dealing with criminal defense most of his career?

Preserves quality relationships with clients. Any sincere professional working in any discipline is aware that at the center of his vocation is his client. You are encountering charges accusing you of a crime and what is at issue here is your fundamental human rights. Therefore, your criminal defense lawyer ought to position his clients above everything else and always make every effort to sustain good working and personal relationships with them. These relationships are not only constructed upon a client-oriented office environment but, more relevantly, heartfelt and open interactions between lawyer and client.

Gets results. This is the one thing that you have to know before shelling out your money for the services of any criminal defense legal representative. What good are inexpensive legal fees and memberships in national organizations if the attorney you select has a losing streak in all cases he deals with? Get recommendations from any potential lawyer, if possible, and question these former clients about their experiences in working with that specific lawyer. Find out if they won or lost their cases and let them explain the strategy that permitted them to win. There are some cases when the lawyer is necessitated to safeguard the privacy of his previous clients, but any one lawyer should, at least, have a number of testimonials to provide their prospective clients.

Demands reasonable fees. This is your future you are putting at stake here. Any person who is dealing with criminal charges of any sort is understandably suffering a psychological and social problem that affects his day-to-day life. It would be a massive disservice for any criminal defense attorney to extort a figure that is worth over the legal assistance that he provides. Flexible fees may seem favorable, at the outset, but any lawyer can use his arguing abilities to shape the fee arbitration to his favor. Always go for criminal defense lawyers with clear to understand fees; they have rid themselves of the opportunity to maneuver any fee agreement and, hence, have no ability to charge from you an amount that is more than the cost of your case.

Possesses a good reputation in the district justice system. In Minnesota, the legal process does not begin with the hearings; it commences with the pre-trial dealings, where your criminal defense lawyer can deal with the prosecuting attorneys to lighten the charges filed against you or even terminate the case altogether. A good reputability among the prosecutors and the entire local Minnesota justice system, thus, is important so that your lawyer can better locate himself during the pre-trial meetings and coax the prosecuting panel that you deserve the reduced charges or sacking of the case he is fighting for.

Don’t know if you have hear of him but KansDefense.com is a great defense lawyer I found while doing my research.

The Dangers Of Driving Unsafe Commercial Vehicles

July 22nd, 2010

One reason that a teenager is so excited to get their driver’s license is because of the ultimate freedom that it grants them. But as their parents never cease to remind them, it also includes a lot of responsibility and needs to be handled with caution. This holds true for anyone on the road, which is why all drivers must always make sure that their cars are safe. When it comes to driving unsafe commercial vehicles, the dangers are even greater.

Anytime someone is out on the highway, even when conditions are ideal, it can be a slightly dangerous proposition. People like to multi-task and often, will change the music or the volume as they drive, creating a small amount of time when they take their eyes off of the road. A lot of people take bigger risks than this in the car, however, such as eating multiple foods or drinking while driving, sending someone a quick text message, or chatting on their cell phones for a long time. Even simply talking to the passenger who is right next to might be enough to take your mind off the road and cause you to miss certain key signals.

Sometimes, people are not sure exactly where they are going and may change lanes at the last minute, swerving their car to the side. This can be extremely dangerous to the cars behind or next to them, who might also have to quickly swerve or stop.

These things can happen under optimal conditions, but it is an even worse story if the conditions are not great to begin with. When someone is operating an unsafe car, they pose a risk not only to themselves, but to anyone driving near them or behind them.

Sometimes, the driver of the vehicle will notice that their car is acting funny, but will not be able to move to the side to address the problem. If they end up stopping suddenly in the middle of the road, they can damage themselves and the car behind them, who might not be able to stop on time. This can affect the next few cars and cause a major accident.

Operating a car like this is not right to the people on the road with you and it is also against the law. If it is discovered that you took out a vehicle that you knew was not working properly, you will not only gain multiple traffic ticket Durham or any kind of traffic ticket Ontario and points, but you might have your license suspended indefinitely.

The government created certain standards that every vehicle must meet in order to be legally allowed out on the roads. By always going to your annual inspection and making sure that the sticker inside your car has not expired, you can be sure that your car is safe enough to drive.

By driving unsafe commercial vehicles, you are taking a risk not only with the law, but also with your life and the lives of those around you. It can be guaranteed that whatever reason you thought you needed to do such a thing is not as important as saving a life.

Getting effective protection after a DUI Durham doesn’t have to be a difficult task – contacting your local criminal lawyer Toronto will help you receive the most comprehensive and quality service imaginable!

The Serious Consequences Of Driving Under Suspension

July 9th, 2010

If you happen to be driving without a permit to drive because your permit has been confiscated then you are driving under suspension. The system of government has removed it for a specific amount of time and it is prohibited that you operate any vehicle. You may be liable to be guilty of another offence by driving at this time.

Different provinces in Canada have different laws for this offense. The amount of the penalty is determined by the frequency of this offense. There is also a possibility of a term of imprisonment. There can be more serious penalties depending on the reason of the offense.

The driver who is stopped by the police and is found to have a suspended license may be detained and arrested. It is possible that the vehicle will be seized awaiting the results of a trial. At trial the length of time in custody is determined.

You can be disqualified everywhere for these kinds of infractions. You cannot drive on private property or in any province in Canada. You are banned from operating any type of vehicle including electrically power vehicles or heavy equipment of machinery. When arrested you are in custody for an undetermined length of time. The location of the infraction will be taken into consideration when evaluating the offence.

The license can be suspended when you have neglected to pay family support that had been previously ordered by the court. If the driver makes the necessary payment to the court then the license is reinstated. As in a traffic violation suspension there is a fine and further infractions are dealt with a possible prison term.

If a driver has an accident and has no liability insurance coverage then it is probable that the authorities will confiscate the permit because the driver cannot pay the damages. The only way to redeem the permit is to pay the damages. However in the meantime if the driver drives a vehicle then he is liable for fines and if this is not the first infraction of driving without the permit there is a chance of imprisonment.

If you have been stopped for speeding or anything that would be considered stunt driving you would lose your license. If you decide to drive after suspension for these reasons then you can be liable to fines or imprisonment. If there are subsequent infractions there may be a term of imprisonment of up to ten years. In some provinces a license can be suspended because there is a point system in place and you have lost all your points.

Possibly while your permit is suspended you may be up for renewal. However, since you are under suspension unless you pay the penalty or fine, or complete the term of imprisonment you will not be in a position to renew you license. This may also be the case if you have accumulated the maximum number of demerit points. Generally the rule for any of the violations is that as a first offender you would not go to jail.
