Additionally, the auction of the property will start at the amount owed on the property and then increase from their, so there is no guarantee that you are going to get a piece of property for pennies on the dollar, but there is a chance that you will.

Once you pay the taxes owed on the property (or the amount that the auction comes to), you receive the deed for the property and you owe it free and clear. Just don’t forget that you too will have to pay taxes on the property you buy or your will end up in the same situation as the previous owners.

When deciding whether an invention is patentable or not, there are five requirements that must be satisfied. These requirements were laid down by Congress, so they can always change depending on the most recent Supreme Court ruling. The first four patentability requirements have to do with the invention itself, while the last requirement is based on how you write your patent submission. The fifth requirement is the reason why most people hire a patent attorney when submitting a patent.

The first requirement pertains to whether or not your invention is able to be protected by a patent. The original law says that anything made by man can be patented; however, there are things that the Supreme Court has deemed unable to be patented. The three categories that have been placed off limits to patents are laws of nature, abstract ideas, and natural phenomena. Although these categories have been ordered to be off limits, the United States Patent and Trademark Office has tried to push the limits and make new standards for patentable subject matter. One of these includes trying to patent business methods; however, the Supreme Court has ruled that they must involve a computer to be patented.

The second requirement requires that an invention is useful in some way. The invention only needs to be partially useful to pass this requirement; it will only fail if it is totally incapable of achieving a useful result. This is a very easy requirement to pass, but it can be failed if you aren’t able to identify why your invention is useful or you don’t include enough information to show why your invention is useful. Also, your claim for why your invention is useful won’t be credible if the logic is flawed or the facts are inconsistent with the logic.

In order to pass the third requirement, an invention must prove to be new in some way. Prior references to your invention play a big part in this requirement because if your invention is identical to any prior art, then it will not receive a patent. These prior references can include previous patents or anything else that mentions your invention. In other words, if a reference such as a newspaper were to get a patent, your invention can’t infringe on it.

If someone knowledgeable about the field of your invention was able to combine a few past references and come to your invention, then it may not pass the fourth requirement. In order to pass the fourth requirement, your invention must be not obvious. This is a tricky requirement because it is an opinion on some level. You are allowed to add past inventions together; however, if such addition would be obvious to anyone in that field, then you can’t receieve a patent. basically, if an invention only contains obvious differences from the prior art, then it will fail this requirement.

The last test is different because it has to do with how you write the patent instead of the invention itself. In order to pass this requirement, the invention must be explained so someone could understand, make and use the invention. There are three parts to the explanation. The enablement requirement requires that the invention is described so others can use and make it. Second, the best mode requirement says there must be a preferred way to carry out the invention described in the patent. The third requirement – the written description requirement – has shady guidelines, so describing your invention in great detail is the best to fulfill this requirement.

In “Swan Pool Supplies Ltd.” the descriptive element is “Pool Supplies” which describes the type of products this business sells. “Dental Services” is the descriptive element for “Union Dental Services Corp.”.

The Legal Element in the name Mining Resources Inc. is the word “Inc.” which is a mandatory ending which recognizes the name as the name of a company. Any company registered in Canada must have one the following endings: “Inc.”, “Incorporated”, “Ltd.”, “Limited”, “Corp.”, “Corporation” and the French equivalents of “Ltee.” “Limitee”, “Inc.” (same in English and French) or “Incorporee”, The Legal Element indicates that the name relates to a company rather than to a business name, partnership or sole proprietorship.

A reputable search house will take the time to try and clear your name by performing as many preliminary name searches as are required to clear your name. Your proposed name could still be rejected even though the search house took the time to check. The report that is generated from the Nuans name search system is called a Nuans name search report. This program’s purpose is to compare a proposed company name to all of the names in its database which are the names of all companies registered as of that date across Canada.

You will not be able to incorporate a company without providing a copy of a Name Search Report. When you go to incorporate the government will compare the name of your company to all the names on the report and this will let them know the name is available for use.

If you are registering a business name or a trade name (also called a sole proprietorship) or a partnership in Alberta you will not be required to obtain an Nuans Report. There is no protection for these names in this province. However it is advisable to at least do a preliminary name search regardless. A preliminary name search will give you an idea whether the name has been taken and what competition you have for the name.

You should also have a preliminary name search done prior to ordering an Nuans name search when registering a company. The reason for this is that once you order the name search it is too late to check the name. If the report shows that your name is too close to another name you will have to order another name search. If conflicts show up on the Nuans report you will need to order another search to ensure you have a name that is clear.

The normal practice is for the search house to perform the preliminary searches as part of the service when ordering a full search report. The only time you should pay for a preliminary name search is in a case where you do not want to order a full search. Examples would be in a case where you are registering an trade name or sole proprietorship and a full name search is not required but you do need to still check to see if the name is available which would be the case in this province.

The onus will be on you to ensure that any business name you register in Alberta does not conflict with another name on file even though you will not be asked to provide a name search report when registering. Therefore it is important that you do a preliminary name search.

It should be noted that when registering an Alberta corporation, it is a requirement that there be a legal element to the name (explained below) but for other registrations such as Alberta business names, this is not necessary.

The Nuans Name Search Report is created from the Nuans Name Search System which records all names for companies, business names and trade-marks across Canada. The system compares the name you wish to use against all other names on file across Canada. You are required to submit an Ontario Nuans Name Search with your articles of incorporation when you incorporate in Ontario. The name search report allows the government to determine if the name is actually available.. All conflicts will show on the report.

When registering a sole proprietorship, trade name (also called an business name) or a Ontario partnership you do not have to provide the government with an Name Search. The government does not provide protection for these types of businesses. You should still perform a preliminary name search to ensure the name is not taken to avoid any legal problems in using a name too similar to another name already registered.

It is advisable for you to have a preliminary name search done for the proposed name you wish for your company. If you do not do this and just go straight to ordering an Ontario Nuans Name search report then if there are conflicts on the report you will have to pay again for another search report.
