The New York Arbitration Act passed in 1920 was followed after five years by the Federal Arbitration Act. The English arbitration law of 1898 was the base for both the New York and the Federal statutes. The Supreme Court has expanded the application of Federal law to almost all aspects covered by the Commerce Clause to effectively result in the preemption of state laws. New York law, allows the vacation of an award under the Federal law if it involved manifest disregard of the law. New York law failed to include the English provision for the review of questions of law. As a result, the law permits a much narrower scope for review by the court of an award granted under arbitration.

In the New York statute Section 7501 governs the effect of the arbitration agreement. Section 7502 covers applications to the court; venue; statute of limitations; and any provisional remedies. A case arising under Section 7502 has revealed how legal remedies can be less adverse than what can arise under the arbitration. The decision of a case has limited the application of a legal test for injunctive relief in arbitration so that in review the case merits are not to be considered. The Section 7504 describes the process of arbitration and sections 7505 to 7511 cover aspects of the award. Section 7512 covers death or incompetency of a party; whereas, Section 7513 covers fees and expenses. Finally, Section 7514 provides for the judgment on the award.

Arbitrators have wide discretion in fashioning their remedy. The basic limitation is that they may not exceed the limits of their authority. The parties can restrict the possible awards the arbitrator can make. No definitive statement may be made on the credentials or experience levels of arbitrators. In some jurisdictions there are standards for arbitrators in certain fields. Independent organizations, such as the American Arbitration Association and the National Arbitration Forum, provide arbitrator training programs and a credentialing venue. Typically, the credibility of the arbitrator is based on reputation, the experience in arbitrating particular issues, or expertise and experience in a particular field. Arbitrators are not required to be members of the legal profession.

Over time, rules have been established for conducting the proceedings and these are typically selected in the agreement between the parties about arbitration. Awards are final and binding upon the parties. Thereafter, the scope of review by a court of law is very narrow. If the subject of a dispute is not forbidden by law from being arbitrated it can be the submitted to arbitration.

A report about a survey of corporations and their preferences regarding the methods of resolving disputes clearly demonstrated their liking for alternative dispute resolution. Almost 90 percent it revealed had used mediation and almost eighty percent used arbitration.

Over eighty percent showed a preference for future use of mediation and just over seventy percent indicated future use of s arbitration. This preference was influenced by the significant factor that mediation allowed parties to control the outcome since both sides have to agree with the determination. Mediation also supported preservation of their relationship. Arbitration, the survey indicated, is selected if it is common in the particular industry. Mediation is not contractually provided for but is used before or during litigation. The case backlogs has led courts and governmental agencies to favor alternate dispute resolution procedures. The EPA declared the city safe for return after just 5 days but the toxins contaminated much of the area’s buildings, walls, furniture and air conditioning systems.

Despite the Environmental Protection Agency declaring the city safe for residents just a few days after the event many thousands of workers, volunteers and residents had already been exposed and if not were putting themselves at maximum risk by returning to the area. A study discovered that 76% of all surviving first responders, workers and local residents are already suffering from respiratory problems.

Around 100,000 people have reportedly been exposed to toxic materials which can cause a variety of lethal diseases such as Asbestosis, Lung Cancer and Mesothelioma. But this number does not include those who have visited and left New York since the attacks which could be much higher.
