The decision of a case has limited the application of a legal test for injunctive relief in arbitration so that in review the case merits are not to be considered. The Section 7504 describes the process of arbitration and sections 7505 to 7511 cover aspects of the award. Section 7512 covers death or incompetency of a party; whereas, Section 7513 covers fees and expenses. Finally, Section 7514 provides for the judgment on the award.

In some jurisdictions there are standards for arbitrators in certain fields. Independent organizations, such as the American Arbitration Association and the National Arbitration Forum, provide arbitrator training programs and a credentialing venue. Typically, the credibility of the arbitrator is based on reputation, the experience in arbitrating particular issues, or expertise and experience in a particular field. Arbitrators are not required to be members of the legal profession.

Over time, rules have been established for conducting the proceedings and these are typically selected in the agreement between the parties about arbitration.
