Conventional Sense Advice To Avoid Speeding Violations

April 23rd, 2011

Not driving your vehicle is a good way to avoid a speeding ticket. But since most of us have to work for a living, that would not be feasible. So for the rest of you who don’t like the thought of using public transportation, these next pointers should be very helpful. Unless of course you like taking the bus.

1. Monitor how fast you’re driving. It shouldn’t need to be said, but if you don’t want a speeding ticket, DON’T SPEED! If you’re going to drive fast, do it on the highway.

2. Be ready to drive. Standing out from the crowd can attract the attention of the police. Walk around your car and ensure that all the lights operate properly, including your headlights, turn signals and taillights. Your mirrors should also be working correctly.

3. Keep your car in good repair. Small issues like cracked windows should be repaired. Use some touch-up paint if your car’s body needs it. Keeping your car clean and in good repair will help you avoid the attention of the police.

4. Stay awake and alert. Keep your seat in the upright position so it’s easy to see what’s outside your car. Watch what’s around you, not just what’s in front, because a police officer could be lurking anywhere. Be wary when you’re approaching bridges, underpasses and curves in the road, because they’re popular places for the police to give out speeding tickets.

5. Avoid suspicion. Seeing a beat up old car driving through a well-to-do neighborhood – especially at night – is suspicious to many police officers. Likewise, although I hate to admit it, the police might become suspicious when they see a Hispanic or black person driving a car in an area that’s predominantly white.

6. Be discrete. You’ll draw more attention from the police when you’re driving a high-performance car than you would if you were driving a Ford Taurus.

7. Be wary of curves. Approach curves carefully as you never what may be waiting on the other side to give you a speeding ticket.

8. Avoid the left lane. Most cops will admit to targeting the left lane of the highway when looking to give out speeding tickets. This lane is known as the ‘fast lane’ and motorists usually do more speeding in this lane than the other lanes.

9. Know whether your city or town has photo radar enforcement. This technology is becoming a more popular way to hand out speeding tickets. Photo radar units can even be concealed inside ordinary SUVs parked along the side of the road.

10. Pay attention ahead of you for brake lights. This is an easy way to be alerted to the fact that there is an officer gunning people for speeding tickets. On highways drivers rarely hit their brakes unless someone has abruptly pulled in front of them.

11. Know what vehicles are driven by law enforcement. Most drivers don’t realize that the car with tinted windows driving alongside might actually an unmarked police car. At least, not until they’re pulled over and handed a speeding ticket! Most unmarked cars are the same model as regular police cruisers, but they have regular paint jobs.

12. Watch out for speed traps. Speed traps are everywhere. Knowing how to spot one and where they may be in your area can be a great way to avoid a speeding ticket.

It’s impossible to avoid all speeding tickets during your driving life, but being aware of these tips can put the odds in your favor.

Can You Beat A Photo Radar Ticket?

April 11th, 2011

The situation plays out every day. Your postal carrier drops off the day’s mail, and you notice an official looking letter from your town’s government. You open the letter to find a traffic ticket. Seems a photo radar camera has busted your vehicle!

Photo radar is a technology that has been rapidly developing since the turn of the century. Photo radar cameras, sometimes called red light cameras, are being placed at strategic locations along well-traveled highways and major intersections. These cameras are equipped with high performance lenses and an extremely bright flash.

The theory is that, a camera takes a picture of any car or truck in the instant it passes by the radar apparatus if for example the car or truck is in fact driving greater than a set speed limit.

The same holds true with respect to red light cameras, where the car or truck entering into an intersection when the stoplight has changed red will cause the camera to take a picture of the backside of one’s car or truck.

In each of those instances a high performance camera lens along with flash is going to take a photograph of the car’s license plate. The actual plate number enables the administration authority to attract a car’s registration details and additionally send the car’s owner a ticket.

But is it foolproof?

No, certainly not.

Several areas happen to be in litigation regarding speed cameras, as countless men and women say these kinds of cameras infringe on our right of privacy.

Quite often these speed cameras can’t tell the complete tale. In one example, a guy was given a speeding citation whilst he was at a hospital going through an operation. A relative had been driving his vehicle on that day, however within the worry of the scenario; no one was able to recall who had been using the vehicle through that specific junction.

In yet another scenario, a guy had been patiently waiting at a stoplight when an ambulance approached from behind having its lights and siren on. The person did exactly what he was in fact meant to do, and thus went through the junction to ensure the ambulance might continue. The only issue was, the guy tripped the red light camera and ended up being sent a ticket, since the ensuing picture of his vehicle within the junction didn’t reveal the actual ambulance at the rear of him.

Luckily, you’ll find technical developments being made to help fight back in opposition to the actual utilization of photo radar.

Even though there are actually several gadgets made which claim to keep the cameras from taking pictures of license plates, consumer services have done checks which in turn indicate the majority of these tools are unreliable.

The one item that supposedly works, and is 100% legal, is a liquid that is sprayed on to your license plate. The high gloss liquid interferes with the camera flash, resulting in a photo with an unreadable license plate. Many local TV stations have tested this product with success, and a quick search on YouTube will provide the proof.

Regardless of how you might feel regarding red light and speed cameras, photo radar is probably here to stay.

However, make sure you do not prolong the time to pay or to settle your speeding ticket fines, especially if you are far from where the ticket was issued. . If the ticket gets issued at a different state than yours, then you have to take care of it through mail or phone. If you have lost your ticket, or if you have no longer gotten hold of a copy of the ticket, the court clerk can give you a detailed statement of your transaction – along with the type of violation you have incurred and the corresponding fine or sanction that needs to be paid.

There are times will you will not be able to find a resolution without using a lawyer. Things To Consider When You Get A Ticket Breaking The Law

October 9th, 2010

You have gotten pulled over driving on your way home from work. The police officer has told you that he is going to issue you a speeding ticket. You have broken the law and since you now have several traffic tickets this year you are going to need to do what you can to get yourself out of it. The consequences of this many speeding tickets is a possible suspension of your driving license and raised insurance rates.

You are issued the ticket for speeding. On the ticket is summons to appear in court if you wish to contest your traffic tickets. Normally you pay the charge and move on with you life but this time you need to see if you can do something to get it erased from your record. You decide you need to find an attorney to represent you.

You can find the names of attorneys online and in the telephone book. You might also ask friends for recommendations. The main thing you want to make sure of is that the attorney specializes in the defense of speeding tickets. Attorneys specialize in areas. You do not want a family law attorney handling your traffic tickets.

Start with a list of a few attorneys. Be prepared with a list of questions that you want the answers to. Ask them what you can expect to happen in your case. The best attorney will be honest with you and tell you even bad news if that is the truth.

There should also be a clear understanding of what you will pay for their services. Often you will either pay a flat rate or a per hour charge. You will have to decide if the cost of defending you case is more important than the ramifications of having the ticket on your record.

The law office will probably conduct an intake interview. They will look at the facts and assess if they want to represent you. This interview may be with a paralegal. A paralegal is trained in the legal field but is not a licensed attorney. They work under the supervision of a licensed attorney. The paralegal will report what they find to the attorney who will make the final decision on if they will accept your case.

As the client, you must also have a sense of trust and comfort with the attorney who is going to represent you. You are choosing them as much as they are deciding on you. A successful defense needs a good working relationship between the attorney and the client.

Honesty with your attorney is imperative. The attorney-client privilege keeps what you discuss protected from being revealed. Take advantage of this and make sure you are clear and forthright with your lawyer.

If you are accused of breaking the law and end up in court you need to behave properly in that setting. Make sure you tell the truth when asked questions by your attorney, the judge, and the prosecutor. You can be punished for lying while on the stand. Lying will get you worse consequences than London traffic tickets and Scarborough speeding tickets themselves.

Scarborough traffic tickets are rampant in Scarborough Ontario. All across Ontario, areas such as Whity, Burlington, and Barrie speeding tickets are being issued in record numbers. Fight back with a paralegal.

You Have Not Got To Be A Victim Of Canada Traffic Law

September 14th, 2010

In the eyes of the law, paying any traffic ticket penalty automatically convicts a person as being guilty for that offense. This is the final thing which you ought to carry out until you have taken into consideration the details associated with your situation. Insurance rates can move up a large amount as the result of paying out an individual speeding penalty. People have noticed insurance costs elevate up to 6 times the initial cost annually as the result of a single traffic ticket offense.

Demerit points, can mean you end up with license suspension. Did you know that insurance providers are able to see any Traffic Tickets that you pay for. The USA and Canada are actually on a compact court system. This means that all the points you get on your license will show up in each of the US and Canada. This is the reason it’s important to battle any traffic tickets.

Every time someone gets supposedly caught speeding they should contest speeding tickets. Unlike some individuals that basically plead guilty to some lower charge to simply decrease the points. You Should not even think about the easy way out in these situations. Many of us make use of all legal remedies accessible to us to accomplish the best results attainable. Some of the experts that are made use of consist of paralegals, radars specialists, toxicologists, a criminal defense firm and so on. The number of people that are succeeding in winning Canadian traffic ticket cases is growing all the time.

No court appearance is required by an individual in Canada courts. Any legal team you use should be able to completely represent you in your place. Now that people are becoming more conscious of what the possible problems associated with paying fines from Toronto speeding tickets tend to be, they are much less willing to do something so quickly. They now query the details of any kind of offence they are charged with. People can sometimes be victims of mistakes made by the authorities. There have been so many stories about failures as well as miscarriages of justice that it is time that individuals stood up for their rights in order to question what they’re getting prosecuted for.

It’s a good thing that more and more people are starting to take on the authorities and are winning. Without these people who had enough belief in their moral standing and honesty we would still be paying left, right and center for things we haven’t done. The law should be there to protect you as a citizen and you should make sure that it does.

Whitby speeding tickets are rampant in Whitby Ontario. All across Ontario, areas such as Whity, Barrie, and Hamilton traffic tickets are being issued in record numbers. Fight back with a paralegal.

Is The Law Protecting The Driver Of Today?

September 11th, 2010

If someone just instantly pays a fine for a speeding ticket or other motoring offense then they are automatically admitting guilt in the eyes of the law. So by default, they are convicting themselves without any question of whether they really have committed an offense. Quite often people will believe that they must be guilty otherwise they wouldn’t have had their license plate or other information. Paying up straight away for something like this is not something you should do in any circumstance and here is why.

Nobody wants to get in deeper trouble than they are already and it’s almost intimidation when you are told to pay early or get more points or higher fines. Through the consultation of a paralegal or other legal services provider, you can better decide what you want to do.

The worst possible thing that someone could do is pay the fine without even asking for the so called evidence. The record that you automatically have against your name is with you for a very long time. If your case is handled properly by a legal team or even just a paralegal then your record could stay unblemished.

That is before you get to the astronomical rise in your cost of insurance. The amount that the cost of your policy would rise is incredible even for what are very minor issues. Some people have found the cost of insuring their vehicle after a speeding ticket unmanageable. Just one ticket can do this to someone and you’d be surprised how many people don’t bother fighting them.

Points or demerits are what could also see you get a suspension. You may be OK with your first offense but if you con’t contest it by the time you get your third it’ll be too late. You could have found that the police used poorly maintained radar equipment when they gathered their evidence for a speeding ticket. If the radar was faulty, then you shouldn’t have to pa any fine whatsoever.

That says it all really, you should contest any case that is brought against you so at least you know that they have genuine evidence to convict. To do this properly you should have at least a paralegal look in to what evidence is to be presented against you. They can check the validity of the evidence and advise you what is best to do at that point. Never seek to settle quickly because there are just too much at stake.

If your are ever in a courtroom situation, you can relax knowing full well that you have got someone beside you that knows what they are doing. The court situation may be a strange world for you but these people will have seen everything a thousand times before. For paralegals and other professionals, it’s living and not just a one time or two time mistake.

Today there is a growing number of people that increasingly willing to take on their cases and they are being won all the time. Why should you pay if the police department can’t be bothered to do their job properly. That’s why the law is there to protect everyone and not to help persecute people.

When driving in Napanee, adhere to parking laws to avoid Trenton speeding tickets. When driving always stick to the rules of the road and respect other drivers. Peterborough speeding tickets unfortunately exceeded estimates in 2009.

How To Beat A Speeding Ticket

August 23rd, 2010

State laws maintain that everybody is protected by equal rights in the eyes of justice. So, even when charged with an offence, culpability is not decided upon unless judged by the court, which even then undergoes through an extensive evaluation.

Although it will require a little effort on your part, by understanding your legal rights it will greatly increase the chance you can beat a speeding ticket.

So to beat a speeding ticket, lets start with the scene of the flagging down, you have the right to limit your answers to a polite “no, officer” and “yes officer.” Known as the Miranda Rights, you are free not to admit your guilt or answer questions that can possibly lead to self-incrimination, especially without the presence of a lawyer.

However, be cooperative enough to provide basic details such as your name and presenting your driver’s license. Be clear that this is not included in your rights of silence.

In order to beat a speeding ticket, you have to do things in a certain way. Being courteous and respectful to another human being can carry significant weight when an officer is still deciding to ticket you or not. Losing your temper or verbalizing insults toward an officer of the law will absolutely guarantee you will NOT get out of a traffic ticket. And if you push the issue too far it can lead to more charges, especially in court.

Your innocence is protected and maintained all through out, so do not be afraid of courts and to beat a speeding ticket. You are not judged unless there is sufficient evidence which is provided by the officer, who is obligated to present the burden of proof, and what you have to do is defend yourself.

Try to remember specific facts about what happened before and while you were pulled over. Being vague wont help. Its easier than most think to beat a speeding ticket, the court gives both sides equal opportunity to present their side.

Some people will bring a lawyer to court, I personally don’t think it is necessary as most people prefer to represent themselves and have a good chance to beat a speeding ticket by simply stating the facts clearly.

You are also granted the right to a speedy trial as traffic courts realize there are time constraints such as personal life and work. If the officer is a no show you can point out the lack of evidence and simply ask to have your speeding ticket thrown out.

Most traffic courts offer alternative to actually paying for a ticket like community service or attending a traffic school class. To beat a speeding ticket means knowing all options available to all people facing charges.

If you can beat a speeding ticket you will benefit greatly because violations are listed in your driving history, which can in turn affect additional charges or increase in your premium rates so you would want to avoid such inconveniences with a clear record.

Traffic violations can be punishing for several reasons. Just keep in mind when trying to beat a speeding ticket, biases and abuse aren’t tolerated by the court. Which means you have as good a chance as anyone to have your speeding ticket dropped when you go to traffic court.

How To Beat A Speeding Ticket And Avoid A Heavy Fine

August 22nd, 2010

There are many unconfirmed stories out in the world about people who have found errors on speeding tickets, they have received and these errors have resulted in a ticket being dismissed. Unfortunately most cases are very difficult to prove and the process can be frustrating.

It can be very frustrating to speed to work on a day that you are late only to get issued a speeding violation that takes even more time than following the speed limit would have. However, more often than not, you find yourself in a scenario where you receive a speeding ticket because as great of a driver as you think you are you still get caught speeding over the limit.

There are a few people who simply pay the fine and continue driving as if nothing had occurred. However, these people may not know that there are a few ways that can get you out of the situation without having to pay a fine – and what’s better is these ways are even legal! This is great for a couple of reasons: not only you have saved money but you have also saved a few points against your license. It does not even matter if you are guilty or not. These tips will give you pointers in how to avoid getting issued a ticket, and if you do how to beat the fine in court.

Most people who have been pulled over encounter the same question- if you know the reason why you were stopped. By asking this, the policeman is attempting to get you to admit you were speeding and thus breaking the rules. Most motorists will probably fall for this type of trick and will immediately admit that they did something illegal. Such admittance gives the police the opportunity to write you a ticket which will probably be hard to defend in court. The best thing to do is to be careful with what you say; tell the officer that you do not know why you are being stopped. Try letting him do the talking; less talk equals less room to make a mistake. You may be fortunate and just get a warning in the end if you appear genuinely innocent about the scenario.

If you have been unfortunate enough to have been issued a speeding ticket, be sure to not pay your ticket through the mail. You should choose to go to court and take the chance that the police officer will not show up. If the officer does not show up to court, your ticket will be dismissed. If you have paid your ticket through the mail you will automatically be guilty and will miss an opportunity to have your ticket dismissed.

If the tips here do not work for you, you have the option of hiring a lawyer who specializes in traffic law. This is another way to try to beat your speeding ticket. The lawyer will know if the circumstances of your citation may be dismissible in court. Using a lawyer this time may help you in the future, if you are issued another ticket.

How To Beat A Speeding Ticket

July 22nd, 2010

The blue lights mean that you have been caught speeding. You chose to drive over the speed limit and now you have some additional choices to make. You can pay the ticket or you can go to court. In court you can hope for a dismissal or you can go before the judge and fight the speeding ticket. Here you will learn a bit more about your options in court; we hope that you will be able to choose the right scenario for you once you have read this article.

Ten miles per hour over the speed limit is likely the speed that most drivers feel comfortable driving at. They know that it is wrong, but they assume that they will not get pulled over for driving 55mph in a 50mph zone. But sometimes it happens, and sometimes people receive tickets for this small infraction. A speeding ticket like this can be very annoying, very time consuming, and could be costly. How you choose to handle the situation from the moment that you are issued a ticket can have a direct impact on how you can beat your speeding ticket.

It is very important to document your traffic stop. You will want to record the time of day, amount of traffic, weather and any circumstances that could be unique to your situation. The officer who has stopped you will have gathered the same or similar information, you should be sure to note any discrepancies. The judge will likely use the officer’s report as part of the permanent record, so if you note anything differently it should be addressed in court. Also be sure, for your own reference, to jot down as much of your conversation with the officer as you remember. This will help you to recall the circumstances of your traffic stop, if you are asked any questions.

The next thing that you should do is file an extension with the court. Once your hearing date has been assigned, you should attempt to change it. If the officer does not appear in court, in most cases your ticket will be dismissed. Police officers tend to schedule all of their hearing on one day, so if you change that day, it is possible that they will not be able to make it to court. When your case is dismissed for the officer not coming to court, you are not responsible for court costs.

Finally, make sure you request to inspect the equipment which was used in clocking your speed. Your ticket will probably get dismissed if they were not able to produce the equipment. Additionally, make sure to ask for service records which come with the equipment. They need to be re-calibrated and serviced after every month so if they do not work properly or if they were not in compliance with the requirement, then you also would be able to beat the speeding ticket.

Read On For Seven Ways To Eliminate Your Traffic Woes!

June 29th, 2010

Traffic around the country gets worse every day. The term “rush hour” is a complete misnomer, since it usually lasts for several hours. Especially in and around major cities, it is nearly impossible to drive on the roadways without being delayed by traffic. So what can you do to avoid traffic? Here are seven tips:

1) Map out alternative routes.

There are ways to go around traffic. If you are like me, then you would rather be moving and take a little longer to get to your destination, than sitting in traffic with the sun beating down on you. So pick a couple of alternative routes on less-traveled roads. After that, try out the routes you have chosen. If you like on, then stick with it. If you like both, even better. If you don’t like either, then choose another alternative route. You can always go back to the original route and sit in traffic. If all else fails, this will add a little excitement to your commute.

2) Check the traffic report before you leave.

Check out the morning news. Periodically, there will be a check of the local traffic, with routes to avoid and accidents to report. This can be very helpful, especially if there is a major accident on your route. Unfortunately, once you get out in the car, you don’t have an updated traffic report to help you out. So, if there is an accident after you receive the report, then you are on your own. Also, traffic reports on the morning news tend to highlight only the busiest of roads, so if you take a back way or a less-traveled road, then you may not be covered.

3) Look to technology.

Buy a global positioning system (GPS) to help you out. Many of the GPS devices will provide real time traffic updates. So, if you are driving in your car and there is an accident ahead, the GPS will warn you. This solves the problem of the accident that occurs after you leave the house, or after you receive the traffic report. Of course, knowing that there is a traffic problem doesn’t provide a solution. That is where the GPS can really come in handy, because you can search for an alternative route.

4) Shift your time.

With new age technology (wi-fi, mobile devices, laptops, etc.), people have much more flexibility with their jobs. The days of everyone working 9:00 a.m. to 5:00 p.m. are over. So if you can get to work a little earlier, then do it. If you can get to work a little later, then do it. The point is to miss the rush hour at one or both ends. That way you can spend a little less time in the car, and a little more time on your work or with your family. It is a win/win situation, if you can do it.

5) Use your resources.

Public transportation is alive and well, and it can be your best friend. Most major cities have buses, trains, and subways to help you get to your destination. Use them. Believe it or not, public transportation is usually more cost effective than spending money on gas and the wear-and-tear on your car. Look at the schedules and try it out for a week. You can always go back to your regular commute.

6) Get some exercise.

That’s right, walk. Not only will you avoid the traffic, but you will be helping the environment and getting exercise at the same time. Everybody wins! In all seriousness, many people live close enough to their workplace or other destination, but choose not to walk because of the fast pace of our society. This is too bad, because walking is one of the best things we can do to keep in shape while alleviating some of the pressure on our roads. So get out there and do it.

7) Move.

Some of us just aren’t cut out for life in the big city. Whether it’s the hustle and bustle of the crowds, the density of the population, or the traffic sprawling in the streets, the disadvantages outweigh the advantages. At that point, it might just be better to move. You don’t have to make that drastic decision, but it is one to be made.

Heavy traffic leads to aggressive driving and, potentially, to a traffic violation. If you want to commiserate with a traffic attorney, be sure to check out attorney news and thoughts from The Pointless Lawyer.
