Welsh Rugby Shame Over Golf Buggy Drink Driving Fiasco

28 year old Andy ‘Brain-dead’ Powell was reportedly arrested by South Wales Police and charged with “driving a mechanically propelled vehicle whilst unfit through drink” under the Road Traffic Act 1988. Powell was found drunk driving a Golf Buggy near junction 3 on the M4.

Powell, 28, was taken into custody before 6am at a motorway service station three miles from the club’s national hotel in the Vale of Glamorgan. The back-row forward had reportedly taken the 15mph vehicle after an all night drinking binge with his teammates and driven it down the hard shoulder of the motorway in order to find food as the hotel was not serving breakfast until 7am.

A spokesman for the Welsh rugby union has stated that Powell has been “suspended from the squad for behaviour contrary to the squad’s code of conduct”.

It is not uncommon for athletes to avoid prosecution especially for driving offences but the circumstances of Powell’s arrest make for a very grey are;. There is no clear definition of a ‘mechanically propelled vehicle’ and there is no strict legal alcohol limit for operating any of them.

Nick Freeman, commonly known as ‘Mr Loophole’ commented that “this could lead to an anomaly where someone is driving a mechanically propelled vehicle, which is not a motor vehicle, whilst over the prescribed limit”.

Although Powell is due in court on March 2nd, it is unclear whether the prosecution will stick with such vague legal boundaries and it could be argued that he broke no law with his driving licence.

Despite the bright outlook for Powell in regards to his drink driving offence, for which he is due in court on 2nd march, he could still be charged for the theft of the golf buggy from the Vale of Glamorgan Hotel if they choose to press charges but there is no comment on the matter so far.

Should McGwire’s Revelation Be Chided or Respected?

Many fans of baseball were surprised by Mark McGwire’s recent confession. The slugger had used steroids for the greater part of his baseball career, as this gave him an unfair edge and contributed to the mammoth seasons that we as fans witnessed.

Most baseball players are thought to have used steroids in order to pump up their offensive stats, thereby securing more valuable contracts in the process. In McGwire’s case, things were different. He simply wanted to recover from any injuries in less time than he’d otherwise be able to.

You may remember that the beginning of McGwire’s career was marked by many injuries that saw him missing the majority of some seasons as a result. His potential was never realized because of this, despite the fact that he averaged more home runs per at bat than any other player of his time.

His strategy seemingly paid off. During the 1990s, McGwire experienced fewer injuries than he had in the prior years, despite the fact that he was older. He also saw a significant boost in his home run total.

Everything came together in 1998, a year in which McGwire set baseball history. Having broken a seemingly unbreakable record held by Roger Maris, the St. Louis Cardinal hit an astounding 70 home runs during the course of the year.

Just a few short years later, a few steroid allegations by Jose Canseco and some admissions by others shocked and devastated baseball fans. Many began to speculate that McGwire was under the influence of these illegal substances too.

In retrospect, it should have been obvious that McGwire and others were using illegal substances. There was no other way to explain the unprecedented jumps in production, and the baseball world should have been keen to this.

Many wonder if McGwire’s recent confession should warrant consideration for the Hall of Fame. While he has failed to make it during the last few seasons, he’s been bold enough to publicly admit what many had already suspected.

UFC Veteran Kimo Leopoldo Alive Despite Media Reports Of Death

Pioneering UFC fighter Kimo Leopoldo is very much alive after numerous mainstream media reports to the contrary. The New York Daily News was first to report the story that Kimo had died of a heart attack, and it quickly spread to other mainstream media outlets. MMA insiders were somewhat skeptical, a there were few details as to the circumstances surrounding his passing, or any real independent confirmation.

A few hours later, the story began to unravel. First, Kimo’s agent indicated that he had spoken to him at 11 PM Monday night and that he was alive and well. He did add that he hadnt spoken to him since, but that he had not received word from anyone close to Kimo of a problem nor had he been contacted by any authorities. Shortly after 2:00 PM Tuesday, Kimos attorney reported that the fighter had been located and was alive and well. Theres still a question of how the report that he was dead made it out in the first place, but the New York Daily News isnt providing much of an explanation–theyve simply deleted the report without comment and will presumably pretend it never happened. There’s some suggestion that the rumor started in an online MMA forum, and Kimo has suggested that he’ll pursue legal action against the perpetrator.

The false death rumors are the latest twist to the utterly bizarre life of Kimo Leopoldo. A native of Munich, Germany, Kimo–he claimed later in his life that he had legally changed his name to simply ‘Kimo’–was the UFCs first over the top personality back when the promotions events were still in the single digits. He was also one of the sports first freestyle fighters in an era when most competitors were specialists in one martial arts discipline.

By the end of 1997, Kimo had compiled a 6-2-1 record with his only losses coming to Gracie and another UFC Hall of Famer, Ken Shamrock. He also earned a draw against a third UFC Hall of Famer, wrestling specialist Dan Severn. His career would be downhill from that point, the result of better fighters entering the sport and his own self destructive lifestyle choices.

To early UFC fans, Kimo became known as much for his flamboyant personality as for his toughness as a competitor. He was a devout Christian, and sported many religious tattoos–most famously a large ‘Jesus’ inscription across his stomach. In an era characterized by low key ring walks, Kimo caused a stir when he entered the octagon at UFC 3 bearing a life sized wooden cross.

Kimo has battled drug and alcohol addiction throughout his life, and in recent years has reportedly became addicted to meth. Hes also tested positive for steroids at a couple of points during his career. In one of his more recent run ins with the law, he was found to be in possession of marijuana and subsequently arrested.

How Banning Sports Betting Undermines The Constitution

The Federal ban on sports betting has been blasted by anyone who knows anything about the subject for a number of different reasons. Though the US professional leagues suggest that sports betting threatens the integrity of their games, the opposite is the case. This is important because there would still be no shortage of outlets for college sport wagering, be it offshore or with your local illegal bookmaker. The professional bookmaking industry is usually where any type of compromised or fixed game is discovered. Ultimately, the true injustice of banning sports betting lies in its contempt for the Constitution.

The Congress of the United States has shown very little respect for the Constitution in recent years. Were it to abide strictly by the role outlined for it by the founding fathers, the Legislative Branch of our government would have to relinquish any number of its powers in a variety of areas. The primary problem with our Congress is that it has increasingly become a collection of career politicians rather than a body representative of its constituency. Every increase in power at the Federal level must be brought about by a usurpation of state and local sovereignty and, more alarmingly, personal liberty.

The Federal prohibition of sports wagering which was enacted a few years back is of very dubious Constitutionality. Were it not for the grandfather clause, which allowed it to remain legal in jurisdictions in which it already existed, it would have certainly been struck down as unconstitutional on a number of different fronts.

The mere fact that a proposed law or initiative is unconstitutional offers no protection for the citizenry. If a politician can suggest that a law is for ‘the children’ many will swallow the bait hook line and sinker. In many cases such prohibitive legislation contradicts one of the most important concepts in the Constitution–that of the right to sovereignty and self-determination of the individual states:

The powers not delegated to the United States by the Constitution, nor prohibited by it to the States, are reserved to the States respectively, or to the people.

In other words, unless the power in question has been expressly given to the Federal government by the Constitution, and/or unless it has expressly been prohibited to the states (as in the case of treaty making) it is the right of each individual state to govern themselves as they see fit. If an individual state chooses not to regulate a certain activity, it is the right of each individual citizen to make their own decision. That was the overriding concern of the writers and framers of the Constitution”that the personal liberty of the individual not be violated by a too-powerful central government.

So, you should be asking yourself at this point, where exactly does the Constitution delegate to the Federal government the right to make policy on sports gambling? The answer is that it doesnt, and it is very questionable that they have the Constitutional authority to do so. The sanctimonious blowhards who oppose sports betting would like to think they know best, but fortunately for all freedom loving Americans the founding fathers would beg to differ.

Sports gambling may seem a minimally important issue to some, but the erosion of liberty is an incremental danger. The danger to broader concepts of personal liberty may seem a million miles away, but with each additional law intended to protect us from this or that the Federal government becomes larger and more powerful and the rights of the sovereign states”and the individuals that comprise them”are shrinking and being weakened.
