When you drive a motor vehicle after having drunk alcohol or taken drugs, you are said to be DUI, or Driving Under the Influence. It is illegal to be driving if you have a certain level of alcohol in your bloodstream as it is dangerous for everyone on the road, yourself included.

California has laws against DUI. You cannot drive if you are under the influence of either drugs or alcohol. This law also extends to piloting planes or boats as well. You can get DUI for being drunk and piloting your boat down a waterway. It’s important to have such laws. Imagine how many lives would be at risk if there was an intoxicated pilot!

When you are sober, you can do two things at once – like steering and braking – at the same time. If you have a blood alcohol content (BAC) of 0.02% this ability is impaired. At BAC of 0.08% you have so much impairment you’re no longer safe to drive.

That is why California instituted a law in 1990 that makes it illegal to drive with a BAC of 0.08% or more. If you are in California, and you are found to have driven with a BAC of this much or more, you will be arrested and charged with DUI.

California is not the only state to have this designation. In fact, many other states have followed suit, and have trained law enforcement personnel to identify when someone is intoxicated.

One such method is the field sobriety test (FST). By virtue of these tests, which are physical agility and reflex tests, officers can estimate if someone has the ability to safely maneuver a vehicle. That doesn’t mean that an FST can identify BAC.

You can measure for BAC via blood or urine sample. These are the most reliable methods. You can also use a machine called a breathalyzer, which can measure BAC via a person’s breath. Which method is used depends on the person and the situation.

Colorado Bans Texting And Driving

On December 1st, Governor Bill Ritter signed into law a bill criminalizing text messaging while driving. The new law will make texting and driving a Class A driving infraction. The new law recognizes the inherent danger in texting while driving, however, the law doesn’t go far enough for many proponents of stricter legislation regarding the use of cell phones in vehicles. When the bill was originally introduced it carried language prohibiting the use of cell phones in vehicles unless a hands free device was used. After meeting opposition from both sides of the aisle over the cell phone usage restrictions, the law will only prohibit drivers under the age of eighteen from using cell phones while driving. As texting is a relatively new phenomenon, there is not significant data on point to show just how dangerous cell phone use (including texting) truly is. As more data emerges on cell phone use and its correlation to car accidents, expect more legislation to arise across the country.
