Traffic Ticket Defense Strategies

January 24th, 2010

At some point or another you are probably going to get a traffic ticket for something. It may be for speeding, forgetting to change your tags, making an illegal turn, or something else. Most who get a ticket end up just paying it. While there are some tickets that can not be beat in court for any reason there are many traffic tickets that can be beat with the right defense.

One of the most common defenses is where you are not aware that you have broken a traffic rule. While many say ignorance is no excuse, at times it is. For example storms can knock down road signs. Vandalism might steal signs or completely cover them. You have a defense here that you were literally unaware of the rule of the road and should not be held responsible for your actions as the signs were posted properly. If something like this happens to you, get some video or photo evidence so that you can defend yourself.

Another common strategy is to research your traffic offense in your local jurisdiction. Generally there are more than a few points that must be proven to make you guilty of that traffic violation. If all these points were not followed correctly, even if it’s a technicality, you can use this as a defense for yourself in court.

Another strategy is to question the reliability of the devices that were used to measure your speed if it’s a speeding offense. These devices have to be calibrated and have documentation from time to time. If this documentation is not legally up to date, you can get out of the ticket as the readings are just hearsay at that point.

Don’t be scared to try to come up with your own defense for your ticket. Most tickets that are challenged in court are dismissed. Learn some ticket defense strategies and do your best.

Find out how to beat speeding tickets and not pay fines. Use proven techniques to build a solid speeding ticket defense and win. Get some Speeding Ticket Help so that you have a better chance of beating your ticket.

Take Some Seattle Traffic Lawyer Advice You Can’t Talk Your Way Out Of A Ticket

January 17th, 2010

We’ve all heard it before. Maybe a friend, a relative, a loved one, an acquaintance, somebody on the bus, whoever it was, they managed to wiggle their way out of a traffic ticket by playing nice with the cops. We’ve all heard these tales of grandeur, and we’re always jealous of it.

And the methods to the madness are all different. There is the crying your eyes out method, which involves beginning to tell a story and tearing up (this one works well with women supposedly). The is the all powerful I was about to crap my pants so I had to speed to a bathroom line. And there is the I’m so sorry please take pity on my method.

Although the stories sound good, in real life, trying this is the last thing you want to do. Trust me, I’m a Seattle traffic lawyer and handle these types of situations every day. The wigglers are the worst, mostly because everything you do equates to telling the cop you are guilty of exactly what he thinks you did.

And you know what? Everything you are spouting, whether crying, holding your shorts, or with your best puppy dog eyes, the cop is remembering to himself. And then when he gets in his car to write your speeding ticket, he’s going to write down everything you say. Not the kind of infraction a Seattle speeding ticket lawyer wants to get.

You know what kills me the most about this too? A large majority of the time it doesn’t work. And by a large majority I mean almost never. The only thing that happens is the cop gets grumpy, you look like a fool, and you have a speeding ticket with your words plastered all over it.

For me, if I’m going to get a speeding ticket, I’m going to take it like a man. I’m not going to say a thing to the officer, including any thought I might have as to why he is writing me a traffic ticket. Having nothing to use against you is a lot better than having some sob story, which in the end looks like a weak attempt to get out of a ticket.

Every Fifteen Minutes: Preventing DUI Driving While Intoxicated And Other Alcohol Related Accidents

January 14th, 2010

DUI Driving while intoxicated is a very bad idea. It can get a lot of people hurt. It can even get them killed. There a lot of prevention programs out there. One of them is called Every Fifteen Minutes.

The Every Fifteen Minutes program originated in Canada. The first Every Fifteen Minutes program took place in Chico. It was done by the Chico police department in 1995.

Every Fifteen Minutes, at time of it’s conception, represented the estimated rate of how long it took someone under the influence of alcohol to cause a fatal crash. This since changed. The program itself is for high school students who are junior and seniors. The planning takes place month in advance. It is normally set up to be done right before prom or homecoming.

This program is geared towards junior and senior high school students. It is usually planned to be done on or right before the week of prom or homecoming. Schools plan the summer before.

This program discusses many alcohol related dangers. The two the focus on the most are alcohol poisoning and drunk driving. They often involve several law enforcement agencies, hospitals, and real parents.

On the first day of the event, Juniors and Seniors are escorted to a large viewing area. They witness a mock crash that includes fire and rescue, police officers, paramedics and the grim reaper. The grim reaper takes the dead victims away. The drunk driver is arrested. Individual who was drunk is arrested.

On the morning of the first day, the student body is gathered outside, normally to the football field. There they witness a mock crash, complete with paramedics, police, and fire and rescue. The grim reaper shows up to take away the dead. The drunk driver is then arrested.

The follow day, the “dead” are turned to their classrooms. They are forbidden to speak during the day. Some schools get elaborate with this part, and have their students use signs around their neck. These signs have how they died, and their name.

The next day, students that were removed are returned to their classes. They are not allowed to speak during the day. Some schools elaborate by having the “dead” wear grave stone signs with their name and how they died printed on it.

At the end of the day, the student body is gathered for an assembly. This assembly wraps up the two day program. Police officers run it. They sometimes show horrifying crash sites in a slide show. These images are often graphic.

Testimonials have showed that this program has had a large impact on the young men and women who have participated in it. They have not gotten into a car with a drunk driver since. The program has done it’s job.

The Every Fifteen Minutes program is still being used today in a lot of schools. It has been heralded as innovative, and poignant. Some places even have their own variation of this program. The goal is still the same: the prevention of DUI driving while intoxicated and other alcohol related incidents.

The Traffic Ticket Attorney And Practical Advice

December 22nd, 2009

Most people ask the traffic ticket attorney what to do when they are pulled over by a police officer and given a traffic citation. The first step is to be cooperative with the police officer. Do not argue and be polite. When the officer hands you the citation simply sign it. Signing the ticket is not an admission of guilt. Next people want to know if they should pay the ticket. The answer is no.

You get nothing from paying the ticket. Your auto insurance will go up because you will get three to four points on your record. Should you go to driving school? Again the traffic ticket lawyer says no. Traffic school costs a lot of money and you still have to pay the traffic ticket fine, the entire amount.

One option that many people do not consider is hiring a lawyer to represent you in traffic court. Often people think the ticket is a lot less than what I would have to pay a lawyer to go to court with me so I will simply pay the ticket. But when you look at the cost of your insurance going up, the cost of traffic school a lawyer may not be a bad choice. But you want to find an attorney that specializes in traffic ticket defense. In fact, the Traffic Ticket Team, www.trafficticketteam.com, is a law firm that focuses on traffic ticket defense. Their lawyers have handled over one million traffic tickets.

Some attorneys even offer a money back guarantee. If he fails to fight your ticket successfully he will refund his fee back to you. So if you end up with points on your record or if you are ordered to traffic school you will get your money back. This is a fair deal. Either way you will not be hit twice with a bill.

Here are some tips to avoiding getting a speeding ticket so you will not end up having to choose from a hiring a lawyer, paying the ticket, or going to traffic school. If you are on the freeway police officers look for those who stand out from the pack. If you are driving on the freeway and you are over taking other vehicles consistently then you are going to stand out from the pack.

And realize there is no such defense of driving with the flow of the traffic. If all cars near you are going seventy five and the limit is sixty five you cannot tell the officer who pulls you over that you were traveling with the flow and expect not to get a citation. But in this case you are less likely to get pulled over driving the same speed as everyone else.

However, once you start to pass and over take cars you will be stopped by the next officer around you. Make certain there is always other cars traveling faster than you on the freeway. The next situation to avoid is the unsafe lane change. Unsafe lane changes account for most freeway accidents. In the interest of safety change lanes in a safe way.

You never want to make an unsafe lane change at anytime for the sake of others on the road and of course for your own safety. But realize that you can get away with speeding sometimes buy never with an unsafe lane change.

What You Should Know About Reckless Driving

December 18th, 2009

Reckless driving ruins lives; it is as simple as that. And it is for this reason that it continues to be such a major violation the world over. To many, it may seem something that only new drivers need to be educated about, however, more experienced road users are just as likely to be guilty of the offense. Whether through being too comfortable behind the wheel, or too confident; there are lessons that need to be understood.

Though it is fair to say that reckless driving rarely results in major injury and trauma for the parties involved; this is more a result of luck. The real issue is that there is always the chance of causing a horrendous event.

The truth is that most drivers have been guilty of driving recklessly at one time or another. In many cases, this has not been caught. Lucky again, but it doesn’t make it right.

For example, speeding is a form of reckless driving. The majority of drivers will argue that they are able to handle an automobile at speed, but what if something goes wrong; the brakes fail or a child steps out? Frightening to think about; terrifying to have to confront.

Whilst it is necessary to overtake slower moving traffic, the constant weaving between lanes; particularly at high speeds, is another danger on the roads that many drivers have committed.

There is no denying that racing friends or family in a car is exciting. And, there is nothing wrong with this; when done in supervised and controlled ways on a track day at a race circuit. But there is no excuse for drag racing on public roads. Often a sport that newly qualified drivers do to show off, it often results in an accident, which can prove fatal.

Above anything else though, the worst form of driving offense is drink and/or drug driving. People committing such an act know full well they are under the influence of intoxicating substances, and so to then continue to drive shows a woeful lack of respect for others.

It is not hard to keep away from reckless driving; all it takes is respect for the vehicle you are driving, respect for your limitations and respect for others. Driving is a privilege, not a right, and we would all do well to remember that.

Traffic Tickets And How To Win In Court

December 11th, 2009

Traffic tickets have nothing to do with justice. They have nothing to do with protection. They are all about the court getting your cash. The traffic court unfortunately is the primary reason for the individual to interact with local government. Now we all know friends or coworkers or relatives who have gotten a ticket and we might have gotten on also.

In order to facilitate the taking of money the traffic court sets the fine at a price so that people will not consider it worth their time and effort to fight the ticket. They want people to believe it is easier to simply pay the ticket. Most people will not want to take time off from work, the court hopes, to fight a one hundred dollar charge. Here is a mind game the court plays. It has all to do with public relations. The court simply wants people to pay the fine.

If all people fought their tickets the whole system would collapse; that or else they would keep lowering the fines until they reached that happy medium to where people would simply pay the fines. Which is what they want but if you look carefully all tickets are invalid none have any validity at all. If you can show that the court has not standing there is no subject matter jurisdiction.

It does not matter the charge against you if the court cannot prove standing. This is a very huge issue and one of the methods to fight a traffic ticket. Realize that a ticket is not a cause of action in the specific legal sense. You must realize that government is created to defend individual rights. Courts, a part of government, are there to defend and maintain the rights of individuals. Thus protecting the rights of individuals is the bases for the court’s jurisdiction.

So a plaintiff to have standing in an American court has to allege the violation of a legal right. Of course they do not like to hear this in a traffic court. The court must show personal injury by the plaintiff. So is the police officer who issued the ticket showing personal injury? Does the prosecutor show personal injury of the so called plaintiff? No.

The violation of an individual right is the basis of subject matter jurisdiction and with no personal injury to a plaintiff there is no jurisdiction and no valid traffic ticket. You can also try to win your case by impeaching a witness who is the cop in almost every case.

You impeach a witness to show the lack of credibility of the witness which makes that testimony inadmissible. You only have to ask two questions of the witness. You ask the officer if he filed a valid cause of action against you. He or she will answer in the affirmative because a negative response means the case had to be tossed out of court.

Your second question is to pose to he witness how many elements are there in a valid cause of action. The prosecuting attorney will then object because the witness is unqualified to respond to the question. The court sustains the objection and you will have demonstrated that the officer is unqualified to testify. Perhaps you may not prevail with this strategy but is one of the methods you can use to fight your traffic ticket.

Traffic Ticket Lawyer – Your Traffic Ticket Resource

November 24th, 2009

Have you ever wondered how on Earth a lawyer could ever fix a traffic ticket? You were speeding and you got caught, how would they be able to get you out of it? Traffic ticket lawyers have this all figured out of course and it isn’t nearly as complicated as you might think. However, it does require you to have legal representation in order for the method to work well.

The trick in how lawyers do this is in the volume of information they have for beating the ticket. In some cases they might find errors, in others they might make it look like they have enough to beat the ticket and scare the prosecutor from pursuing and in some instances they might just ask for a pass.

A story I have heard many times is of those getting a speeding ticket and the lawyer thinking the best thing to do would be to ask for the charge to be reduced to a non-moving violation. This gives the court something to charge you with while not effecting your insurance.

There have been people in the past that have been charged with both a speeding violation as well as a DUI and usually the two were dealt with on separate court dates. If this happens they often luck out and have the DUI completely cleared up before appearing for the ticket.

If this is the case, the lawyer can speak with the prosecutor before the hearing begins and inform them that the DUI has been handled already. Then they can ask what could be done to get the violation reduced for you so that you can move on. Usually the two lawyers will be able to come to some type of agreement on this matter.

This doesn’t happen every single time and in some instances your lawyer might have to threaten going to trial to get anything done. If they have won similar cases in the past it does weight heavily on the courts decision. This is why having a lawyer is critical in these situations if you want to come out on top.

Your lawyer will have the knowledge and experience to spot any problems with the case and form a strategy around that. This is not saying you wouldn’t be able to do it all yourself, but the best results come from having a lawyer on your side so that every possible option you could take are evaluated proficiently.

Secrets About How A Traffic Ticket Is Handled Or Avoided.

November 9th, 2009

Driving a vehicle gets you to destinations a whole lot faster than walking but there are some inescapable consequences for such actions. One such consequence is a traffic ticket being issued by a traffic officer. But there is no real need to worry because certain information in this article will help you navigate yourself out of trouble. Being late for work is normal and in such cases you will have to over speed; it’s a part of life if you have a car.

A traffic ticket is handed out when you break a traffic rule or regulation. Infractions are small violations like speeding and misdemeanors are serious violations that involve reckless driving. A natural consequence of minor offenses is usually a fine and if it’s serious the crime can lead to imprisonment. That said let’s get into more detail.

Appearance in court is a result of being given a traffic ticket. One way or another you will have to go to court and prove your guilt or innocence. To some appearing in court may be so trivial that they might decide not to go to work at all. In court they require you to testify as to what happened exactly and the state has the opportunity to call witnesses. But if you don’t want to appear you can make use of the trial by written declaration whereby you don’t appear in court and instead hand in documents of your testimonies.

The trial by written declaration is one sure way of avoiding the fury of the traffic officer on the day in question. The problem with going to court is that your mere physical presence can remind the judge of your past violation and he’ll decide to be harsh on you. Traffic Bust is a company of legal advisers that specializes in trials by written declaration and they are very good at their job.

A witness is an effective person to have in court on the day of the trial. An effective and unbiased witness will overcome the judge’s bias to always support the evidence of police officers. A better witness would be someone who you don’t know but was at the scene.

Ensure you show up at the courts on the scheduled date for trial. Not showing up is an almost contempt of court charge leveled against you that usually leads to an arrest or a notice to appear in court. Check your trial dates and make sure you don’t miss them. Chances are that no one but you will show up. Inevitably your case might be dismissed.

Being confrontational with a traffic officer is what leads to being slapped with a traffic ticket. Arguing will only make things harder for you at court if the officer decides to show up and make an aggravating testimony about your attitude. Smile and be polite to the traffic officer, it’s way better than being given a fine.

The best way to avoid traffic tickets is by being a law abiding citizen. Traffic violations are petty and they should be avoided at whatever cost, even if it means rising an hour later so that you won’t have to speed.

Traffic offenses that lead to getting tickets are small and should be avoided at all costs.

Know How To Handle Yourself When Getting A Traffic Ticket

November 7th, 2009

When you hear the sirens behind you, the first thing to remember is not to panic. Just take a deep breath and pull over as safely as possible. Do not take off your seat belt as you might get a traffic ticket for this as well. Do not open the glove compartment to get your registration. Do keep your hands on the steering wheel so the Officer can see them and roll down your window. Then when he asks for your registration and license, you can retrieve them for him. All of this is done before he decides whether or not to write you a traffic ticket.

So there you are staring at the most powerful person in the entire legal process in out great country, the Officer you see on the street when its just you and him and he has all the power and you have none. Just relax, he is going to first run your drivers license to make sure you do not have a warrant for your arrest and to make sure you are not some escaped axe murderer. Once he establishes that you are not a threat to his safety he is going to ask you what seems like a very innocent question, but its actually the most common way to elicit a confession in the world and almost everyone falls for it. He will ask you if you know why he pulled you over or he will ask why you are in such a rush. If you are like most people, you will take the bait and tell him you were speeding but not that fast or you will tell him that you were speeding because you need to get to the office and you are running late.

The Police Officer will now probably write you a traffic ticket and put a note on it that you admitted it. He may even tell you he clocked you doing 80 in a 40. He may start to lecture you about speeding and the fact that you are an accident waiting to happen. Of course by this time, you will try one of two WRONG approaches. You will first start to argue that there is no way you could be doing 80 miles per hour because your car is not that fast. Or you will say you were just keeping up with traffic and he got the wrong car. Or you might try the other wrong approach and try to be sweet by saying you are sorry but you needed to get to work or you had a date with a hot girl and didn’t want to miss it. Neither of these approaches is smart. Oh and before you think it, I will tell you the “I really have to go to the bathroom” is not good either. He will tell you to think about how much longer it would have taken to get to the bathroom if you crashed along the way.

If you are going to have any chance of winning in Court, you have to do what is hardest for most people, keep your mouth shut. Don’t start apologizing for what you did. And do not start to argue. If he asks you why you think he pulled you over, tell him “no officer, I don’t”. Don’t be smug about it and don’t be coy, just act innocent. After he tells you why, don’t argue with him. Just take the ticket and move on. The most important thing that the officer needs to remember about his entire interaction with you is that he remembers nothing. That is to say, the whole encounter needs to be unremarkable. You see the faster the whole transaction and the smoother it goes in every respect, the less likely the Police Officer is to show up for court. Also, should the Police Officer show up in Court, it is very unlikely that he will remember anything about the interaction four months later. Thus, if he is challenged by someone in Court about the fact surrounding the stop of your vehicle, he is not likely to remember anything and thus your case is more likely to get dismissed.

Now the drama is over and you have the traffic ticket in hand. What should you do. You can pay it and get points. You can go to school and pay the ticket, the school, the state of Florida and give up your right to go back to school. Or you can do what most people do, hire the traffic ticket team.
